1. Agreement to Terms
By accessing or using ABAB Word ("the App"), a product of ABAB Labs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.
2. Description of Service
ABAB Word is a vocabulary learning application that uses AI-powered technology and spaced repetition algorithms to help users learn and retain new words. The service includes:
- Access to vocabulary learning content and word lists
- AI-powered personalized learning recommendations
- Progress tracking and analytics
- Interactive learning exercises and quizzes
3. User Accounts
3.1 Account Creation
To use certain features of the App, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Eligibility
You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent to use the App.
4. User Responsibilities
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Violate or infringe upon the rights of others, including intellectual property rights
- Transmit any viruses, malware, or other harmful code
- Attempt to gain unauthorized access to any portion of the App or its systems
- Interfere with or disrupt the App's functionality or servers
- Use automated systems or software to extract data from the App
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Sell, rent, lease, or otherwise commercialize the App without our permission
5. Intellectual Property Rights
5.1 Our Content
All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, software, and learning materials, are the exclusive property of ABAB Labs and are protected by copyright, trademark, and other intellectual property laws.
5.2 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.
5.3 User Content
You retain ownership of any content you create or upload to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing and improving the App.
6. Subscriptions and Payments
6.1 Subscription Plans
The App may offer free and paid subscription plans. Subscription fees, billing cycles, and features are subject to change with notice.
6.2 Payment
If you purchase a paid subscription:
- You authorize us to charge your payment method on a recurring basis
- Subscriptions automatically renew unless canceled before the renewal date
- All fees are non-refundable except as required by law
6.3 Cancellation
You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period.
7. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the App will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy, reliability, or completeness of content
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABAB LABS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or use
- Any damages arising from your use or inability to use the App
- Any damages exceeding the amount you paid to us in the twelve months preceding the claim
10. Indemnification
You agree to indemnify, defend, and hold harmless ABAB Labs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to:
- Your violation of these Terms
- Your use of the App
- Your violation of any rights of another party
11. Modifications to the App and Terms
11.1 App Modifications
We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice or liability.
11.2 Terms Modifications
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Termination
12.1 By You
You may terminate your account at any time by contacting us at support@abablabs.com or through the App settings.
12.2 By Us
We may suspend or terminate your account at any time if:
- You violate these Terms
- We are required to do so by law
- We discontinue the App or any portion thereof
12.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. We may delete your account and content without liability.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which ABAB Labs is incorporated, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
14. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and ABAB Labs regarding the App and supersede all prior agreements.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
